IMPLEMENTATION STATUS OF GOVERNMENT PROCUREMENT RELATED ARTICLES OF CEFTA

Detailed description of project

Overall objective:
The overall objective of the project of which this contract will be a part is to assist CEFTA Parties to review:
- the status of implementation of CEFTA Agreement provisions on GP of goods, works and services (Articles 34-36 including Articles 26-29 on services);
- the progress in the opening of their GP markets.
Purpose:
The purpose of this contract is to strengthen the efforts of CEFTA Parties to:
- Ensure that the GP takes place in a transparent and reasonable manner;
- Treat all suppliers of the other Parties equally;
- Obtain that the procurement is based on the principle of open and effective competition;
- Achieve progressive and effective opening of its GP markets.

Type of services provided

The assignment will produce a set of outputs and deliverables which should assist CEFTA Parties in several assignments.
The consultant is expected to focus on the analyses of legal and institutional framework of the procurement process including its enforcement in each CEFTA Party in compliance with the relevant CEFTA provisions, WTO rules and main principles and standards of the EU Acquis, including capacities of regulatory and review GP bodies. The analysis should help the consultant to provide recommendations with the aim of full implementation of CEFTA related articles, alignment with the WTO rules and EU regulation3 and practice, having in mind integrity of a public procurement system, publicity in the work of public authorities, free access to information and remedies system. For this purpose the consultant will meet the representatives of relevant institutions to acquire more detailed information in each Party. For the purpose of monitoring the implementation and enforcement of GP rules related articles of CEFTA the consultant will produce recommendations for improvement of obligations arising from relevant CEFTA articles based on availability and comparability of data. In addition, the consultant should adequately address bilateral and/or regional related issues in CEFTA Parties if any, in particular their non-discriminatory practice, and provides proposals for resolving them. The Consultant is also to make analysis of the potential to intensify cooperation amongst GP regulatory and implementation authorities in the Region and proposals on concrete forms of cooperation taking into account the existing forms of cooperation among regulatory and review bodies in the Region. The consultant should prepare Proposals of required technical assistance to assist CEFTA Committee of Contact Points and regulatory and review GP bodies in the Region to promote their activities and cooperation.
